Privacy Policy

This Privacy Policy explains how Edmund Lara, a licensed real estate agent with The Agency Las Vegas ("we," "us," or "our"), collects, uses, shares, and protects information when you visit thehousealwayswins.vegas (the "Site") or otherwise interact with us, including by phone, email, or text message.

By using the Site or providing us your information, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site.

1. Who We Are

Edmund Lara is a licensed real estate professional affiliated with The Agency Las Vegas, serving the Las Vegas, Nevada metropolitan area and clients relocating to the region. You can reach us any time at me@edmundlara.com.

2. Information We Collect

a. Information you provide directly. When you fill out a form, request information, sign up for a home search, request a home valuation, subscribe to updates, or contact us, we may collect:

  • Your name
  • Email address
  • Phone number
  • Mailing or property address
  • Property preferences and search criteria (price range, location, home type, timeline, motivation to buy or sell)
  • Any message, question, or information you choose to share with us

b. Information collected automatically. When you visit the Site, we and our service providers may automatically collect:

  • IP address and approximate location
  • Browser type, device type, and operating system
  • Pages viewed, links clicked, listings viewed, and time spent on the Site
  • Referring website and search terms
  • Cookies and similar tracking technologies (see Section 6)

c. Information from third parties. We may receive information about you from lead-generation partners, our customer relationship management (CRM) provider, multiple listing service (MLS)/IDX providers, mortgage or lending partners you engage, and analytics or advertising platforms.

We do not knowingly collect sensitive personal information (such as Social Security numbers, financial account numbers, or government IDs) through the Site. If such information becomes necessary during a real estate transaction, it is handled separately through secure transaction channels, not through the Site.

3. How We Use Your Information

We use your information to:

  • Respond to your inquiries and requests
  • Help you search for, buy, sell, or evaluate real estate
  • Send you listings, market updates, and information relevant to your goals
  • Schedule and confirm appointments and showings
  • Send you text messages and calls you have consented to receive (see Section 5)
  • Improve the Site and our services
  • Comply with legal, regulatory, and professional obligations
  • Protect against fraud and secure our systems

4. Legal Basis and Your Choices

We collect and use your information based on your consent, to fulfill your requests, and for our legitimate business interests as a real estate service provider. You may opt out of marketing communications at any time (see Sections 5 and 8).

5. Text Messaging (SMS) and Mobile Information

When you provide your phone number and opt in through a form on our Site, or otherwise expressly request to be contacted by text, we may send you text messages (SMS) related to your inquiry, appointments, reminders, property and market information, and service updates. Consent to receive text messages is not a condition of any purchase.

  • To opt out, reply STOP at any time. You will receive a confirmation and no further texts.

No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. We do not sell your phone number. Text-messaging opt-in data and consent will not be shared with any third parties. All other categories of information sharing described in this policy exclude text-messaging originator opt-in data and consent; that information is not shared with any third parties.

6. Cookies and Tracking Technologies

The Site uses cookies and similar technologies (such as pixels, tags, and local storage) to operate the Site, remember your preferences, analyze traffic, measure performance, and support marketing. These technologies may collect information about your activity on the Site over time.

Some of these technologies are operated by third parties (for example, analytics and advertising providers) that may track your activity across other websites over time. You can control cookies through your browser settings and may be able to opt out of certain analytics and advertising cookies. Note that disabling cookies may affect how the Site functions.

We honor recognized browser-based opt-out signals, including the Global Privacy Control (GPC), where required by law.

7. How We Share Information

We may share your information with:

  • Service providers who perform functions on our behalf (such as our CRM, Follow Up Boss, our website host and platform, email and text-message delivery services, and analytics providers), solely to provide services to us and under obligations to protect your information.
  • Real estate and transaction partners you choose to engage, such as lenders, title companies, inspectors, or other agents, to facilitate your transaction.
  • MLS/IDX providers as required to display property listings and comply with MLS rules.
  • Legal and safety recipients when required by law, subpoena, or to protect our rights, your safety, or the safety of others.
  • Business transfers in connection with a merger, acquisition, or sale of assets, subject to this Privacy Policy.

We do not sell your personal information for money, and we do not share your text-messaging opt-in data or consent with any third party.

8. Your Privacy Rights

a. All visitors. You may request to access, correct, or delete the personal information we hold about you, or opt out of marketing communications, by emailing me@edmundlara.com. To unsubscribe from texts, reply STOP; to unsubscribe from emails, use the unsubscribe link or contact us.

b. Nevada residents. Under Nevada law (NRS Chapter 603A), Nevada consumers have the right to submit a verified request directing us not to sell their covered personal information. Nevada defines a "sale" narrowly as the exchange of covered information for monetary consideration for the recipient to license or sell it to additional parties. We do not engage in such sales. To submit a request or ask a question, email me@edmundlara.com. We will respond within 60 days (extendable by 30 days with notice).

c. California residents. To the extent the California Consumer Privacy Act (CCPA/CPRA) applies, California residents have the right to:

  • Know what personal information we collect, use, disclose, and the sources and purposes;
  • Delete personal information we have collected, subject to exceptions;
  • Correct inaccurate personal information;
  • Opt out of the "sale" or "sharing" of personal information (note: we do not sell or share personal information as those terms are defined);
  • Limit the use of sensitive personal information (we do not use sensitive personal information for purposes requiring a limit right);
  • Non-discrimination for exercising your rights.

You may designate an authorized agent to submit a request on your behalf. Because we operate primarily online and maintain a direct relationship with you, you may submit requests by emailing me@edmundlara.com. We will verify your request using the information we have on file before responding.

9. Data Retention

We retain your personal information for as long as needed to provide services, maintain our client relationship, comply with legal, tax, and professional record-keeping obligations, and resolve disputes. When information is no longer needed, we take reasonable steps to delete or de-identify it. Real estate transaction records are retained as required by Nevada real estate law and brokerage policy.

10. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Third-Party Links

The Site may contain links to third-party websites and services (such as lenders, listing portals, or social media). We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies.

12. Children's Privacy

The Site is intended for adults and is not directed to children under 18. We do not knowingly collect personal information from children under 18. If you believe a child has provided us information, contact us at me@edmundlara.com and we will delete it.

13. Fair Housing

We are committed to the letter and spirit of U.S. policy for the achievement of equal housing opportunity. We do not use your information to discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity, or any other characteristic protected by federal, Nevada, or local fair housing law.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last Updated" date above and post the revised policy on this page. Where required by law, we will provide additional notice. Your continued use of the Site after changes take effect constitutes acceptance of the revised policy.
